O MINISTRO DE ESTADO DO TRABALHO E EMPREGO, no uso das atribuições que
lhe conferem os incisos I e II do parágrafo único do art. 87 da Constituição, e tendo em
vista o disposto no Decreto nº 11.359, de 1º de janeiro de 2023, resolve:
Art. 1º A Portaria MTP nº 3.959, de 1º de dezembro de 2022, passa a vigorar
com as seguintes alterações:

§ 1º Os atuais titulares e substitutos das funções de chefe de Agências ficam
designados para as Funções Comissionadas Executivas de que tratam os Anexos IV e V,
ficando dispensados da titularidade e do encargo de substituto da função anterior.
§ 2º O disposto no § 1º se aplica somente nos casos em que tenha ocorrido
alteração do nível da função." (NR)
Art. 2º Esta Portaria entra em vigor na data de sua publicação, com efeitos
retroativos a 8 de dezembro de 2022.
