Além disso, a peticionária transcreveu decisão do Painel da OMC no caso China - Automobile (EUA) que demonstraria que a análise poderia ser feita com base na representatividade da indústria doméstica em todo o período de dano: "MOFCOM determined that the aggregate annual output of the producers represented by the petitioner accounted for 54.16% (2006), 33.54% (2007), 33.75% (2008), 36.32% (interim 2008), and 41.94% (interim 2009) of total Chinese production of the domestic like product (...) We recall that producers in the domestic industry accounted for no less than 33.54% of total domestic production during the period examined, and as much as 54.16%. In the absence of some further explanation, we fail to see why these percentages should be considered to be low, let alone why MOFCOM should have been required to show justification in this regard." (grifo da peticionária) (iii) Uma indústria doméstica poderia representar menos do que 50% da produção nacional e caracterizar uma proporção significativa da produção nacional, desde que configure proporção "importante, séria ou significativa", consoante os fatos do caso; 274. A Qualicaps argumentou que não haveria limite mínimo de porcentagem para que a indústria doméstica seja considerada como proporção significativa nos termos do Acordo Antidumping, o que dependeria dos fatos de cada caso e da dinâmica da indústria em questão, devendo configurar proporção "importante, séria ou significativa". Nesse sentido, destacou trechos de Relatórios do Painel da OMC nos casos Argentina - Poultry e EC - Fa s t e n e r s , conforme reproduzido a seguir: "an interpretation that defines the domestic industry in terms of domestic producers of an important, serious or significant proportion of total domestic production is permissible. Indeed, this approach is entirely consistent with the Spanish version of Article 4.1, which refers to producers representing "una proporción importante" of domestic production. Furthermore, Article 4.1 does not define the "domestic industry" in terms of producers of the major proportion of total domestic production. Instead, Article 4.1 refers to producers of a major proportion of total domestic production. If Article 4.1 had referred to the major proportion, the requirement would clearly have been to define the "domestic industry" as producers constituting 50+ per cent of total domestic production. However, the reference to A major proportion suggests that there may be more than one "major proportion" for the purpose of defining "domestic industry". In the event of multiple "major proportions", it is INCONCEIVABLE that each individual "major proportion" could - or must - exceed 50 per cent. This therefore supports our finding that it is permissible to define the "domestic industry" in terms of domestic producers of an important, serious or significant proportion of total domestic production. For these reasons, we find that Article 4.1 of the AD Agreement does not require Members to define the "domestic industry" in terms of domestic producers representing the majority, or 50+ per cent, of total domestic production". "(¼) As the parties have recognized [European Union and China], a "major" proportion is one that is "important, serious, or significant".492 The parties also agree that the "major proportion" referred to in Article 4.1 of the AD Agreement may be something less than 50 per cent, and that the lower limit is not determinable in the abstract, but will depend on the facts of the case. This is consistent with the views of the panel in Argentina - Poultry (¼) (grifos da peticionária) 275. A Qualicaps destacou que o Painel teria aceitado a proporção de 46% da produção nacional como "importante, séria ou significativa" e o Órgão de Apelação não teria refutado uma representatividade de 27% como proporção significativa, tendo transcrito trecho do Relatório do Painel no caso China - Automobile: "(¼) We note in this respect that a panel previously accepted 46% of total production as sufficiently "important, serious or significant" to constitute a major proportion of total domestic production.[318] Further, the Appellate Body in another dispute did not a priori exclude the possibility that a figure as low as 27% of total domestic production might constitute a major proportion of total domestic production, depending on the circumstances." (grifo da peticionária) 276. No mesmo Painel, o órgão da OMC teria concluído que o critério de proporção significativa seria configurado quando, considerando os cinco períodos de análise de dano, a indústria doméstica teria atingido o máximo de 54,2% e o mínimo de 33,5% da produção nacional: "(¼) We recall that producers in the domestic industry accounted for no less than 33.54% of total domestic production during the period examined, and as much as 54.16%. In the absence of some further explanation, WE FAIL TO SEE WHY THESE PERCENTAGES SHOULD BE CONSIDERED TO BE LOW, LET ALONE WHY MOFCOM SHOULD HAVE BEEN REQUIRED TO SHOW JUSTIFICATION IN THIS REGARD." (grifos da peticionária) (iv) O critério de proporção significativa também seria qualitativo, cabendo avaliação qualitativa dos fatos e evidências disponíveis; 277. Segundo a peticionária, caberia avaliação qualitativa dos fatos e evidências disponíveis no caso em concreto a fim de se concluir a respeito da configuração da proporção significativa caso a indústria doméstica tenha participação menor do que 50% da produção. Nessa esteira, apresentou trechos do Relatório do Órgão de Apelação da OMC nos casos EC - Fa s t e n e r s e Russia - Commercial Vehicles, como reproduzido a seguir: "We thus read the requirement in Article 4.1 that domestic producers' output constitute a 'major proportion' as having both quantitative and qualitative connotations." "The Appellate Body has explained that, by using the term "major proportion", the second method of defining the domestic industry focuses on the question of how much production must be represented by those producers of the like product making up the domestic industry when the domestic industry is defined as less than the domestic producers as a whole.[71] The Appellate Body has read the "major proportion" requirement in Article 4.1 as having both quantitative and qualitative connotations. Regarding the quantitative element, Article 4.1 of the Anti-Dumping Agreement does not stipulate a specific proportion for evaluating whether a certain percentage constitutes a "major proportion"[73] (¼) The qualitative element, in turn, is concerned with ensuring that the domestic producers of the like product that are included in the definition of domestic industry are representative of the total domestic production". (grifos da peticionária) (v) A autoridade investigadora teria flexibilidade para definir "proporção significativa" diante da ausência de risco de distorção 278. A peticionária argumentou que a autoridade investigadora teria flexibilidade na definição de indústria doméstica, tendo apresentado o seguinte trecho de decisão do Relatório do Órgão de Apelação no caso Russia - Commercial Vehicles: "[W]e recall that the Appellate Body has recognized the difficulty of obtaining information regarding domestic producers in certain situations, such as fragmented industries with numerous producers. In such special cases, the term 'major proportion' in Article 4.1 allows an investigating authority a certain degree of flexibility in defining the domestic industry. Nevertheless, an investigating authority continues to bear the obligation to ensure that the way in which it defines the domestic industry does not introduce a material risk of distortion into the injury analysis." (grifos da peticionária) 279. Reiterou que a indústria doméstica deve servir de padrão para refletir a realidade da indústria nacional como um todo de forma a permitir análise acurada do dano pela autoridade, tendo apresentado o seguinte trecho do Relatório do Órgão de Apelação da OMC em EC - Fa s t e n e r s : "'A major proportion' of such total production will standardly serve as a substantial reflection of the total domestic production. ¼ In our view, the above interpretation is confirmed by the purpose of defining the domestic industry under the Anti- Dumping Agreement. As footnote 9 to Article 3 of the Anti-Dumping Agreement indicates, the domestic industry forms the basis on which an investigating authority makes the determination of whether the dumped imports cause or threaten to cause material injury to the domestic producers. ¼' a major proportion of the total domestic production' should be determined so as to ensure that the domestic industry defined on this basis is capable of providing ample data that ensure an accurate injury analysis." (grifos da peticionária) 280. Para a Qualicaps, a não participação de algum produtor nacional não significa risco de distorção, de modo que, se superados os aspectos processuais do art. 37 do Decreto nº 8.058, de 2013, parágrafos 1º e 2º, o risco de distorção seria improvável. Nesse sentido, destacou trecho de decisão do Painel no caso China - Automobiles (EUA), como transcrito a seguir: (¼) the mere fact that some producers may choose not to do so, i.e., "self- select" out of coming forward, to use the US terminology, does not, in our view, introduce a material risk of distortion in the IA's process of defining the domestic industry. In our view, merely that domestic producers might choose not to participate does not mean that the registration requirement leads to a definition of domestic industry inconsistent with Articles 4.1 and 16.1. Provided a registration requirement strikes an appropriate balance between the right of interested parties to participate in an investigation, and administrative efficiency, we see nothing in the relevant provisions that would preclude it (¼) 7.225. We note that there is nothing in the text of the Anti-Dumping or SCM Agreements establishing a methodology for defining the domestic industry in an investigation. In our view, the possibility that weaker-performing producers in a given industry will more strongly support an AD or CVD investigation or be more likely to participate actively is simply a reflection of the realities of trade remedy actions. The possibility of imposition of definitive AD and/or CVD measures will afford all producers relief from lower-priced imports, but producers performing less well will tend to have a greater incentive to seek initiation of and participate in an investigation. WE FAIL TO SEE HOW THIS FACT, WHICH IS BEYOND THE CONTROL OF AN IA, IS AFFECTED BY THE REQUIREMENT THAT PRODUCERS REGISTER AND PROVIDE CERTAIN INFORMATION IN ORDER TO PARTICIPATE (¼) We recall that Articles 5.4 of the Anti-Dumping Agreement and 11.4 of the SCM Agreement provide that an AD or CVD investigation may only be initiated based on an application made "by or on behalf of" the domestic industry.352 Further, Articles 5.4 of the Anti-Dumping Agreement and 11.4 of the SCM Agreement preclude the initiation of an investigation where producers expressly supporting the application account for less than 25% of total production, or where producers supporting the application account for less than 50% of production of those producers expressing an opinion. Thus, the possibility that a domestic industry could, by self-selecting participation in the investigation obtain an AD or CVD measure which is unjustified seems extremely unlikely. Certainly nothing in the circumstances of this case suggests that this happened in the investigations at issue. (grifos da peticionária) (vi) A parte que alega a inaplicabilidade da "proporção significativa" teria o ônus de comprová-la 281. A esse respeito, a Qualicaps apresentou trecho do Relatório de Painel e do Órgão de Apelação no caso EC - Fa s t e n e r s , além de parte do Relatório do Painel no caso China - Automobiles, reproduzidos a seguir: "A complainant alleging an inconsistency under the second method for defining the domestic industry bears the burden to prove its claim and to demonstrate that the domestic industry definition does not meet the standard of 'a major proportion'." "7.227 (¼) Thus, the question for us is whether, in light of the facts on the record of the anti-dumping investigation before us, there is anything that supports China's contention that 27 per cent of estimated EU production of fasteners is not an important, serious, or significant proportion of total domestic production of that product." "7.229. We further consider that the United States has not substantiated its argument that the percentages of total domestic production accounted for over the POI by domestic producers included in the industry defined by MOFCOM were low and that MOFCOM should have explained its rationale for allowing such low percentages to reflect a major proportion of total domestic production. We recall that producers in the domestic industry accounted for no less than 33.54% of total domestic production during the period examined, and as much as 54.16%. In the absence of some further explanation, we fail to see why these percentages should be considered to be low, let alone why MOFCOM should have been required to show justification in this regard. Dessa forma, segundo a peticionária, a mera alegação de que o critério de proporção significativa não teria sido cumprido, ausentes evidências argumentativas ou metodologia alternativa mais adequada, não seria suficiente para satisfazer o ônus da prova. 283. Em seguida, tendo apresentado os precedentes multilaterais, a peticionária argumentou que atende ao critério de proporção significativa no presente caso, tendo apresentado os argumentos elencados a seguir. (i) O critério de "proporção significativa" pode ser satisfeito com dado de período de dano distinto ao P5 e, entre P1 e P4, a peticionária teria ultrapassado o percentual de 50% da produção nacional 284. A esse respeito, a Qualicaps alegou que atenderia ao critério de "proporção significativa", uma vez que registrou 61,7% da produção nacional no período mais recente de dano em que não haveria risco de distorção, tendo em vista que o DECOM possuiria dados primários a respeito da produção da outra produtora nacional em P4. Recordou, nesse contexto, que, no contencioso EC - Fa s t e n e r s (China), a China teria levado à discussão multilateral o argumento de que a Comissão Europeia teria violado o Artigo 3.1 do Acordo Antidumping por não definir a indústria doméstica em relação ao período de análise de dumping e por considerar, para fins de análise da proporção significativa, o ano calendário de 2006 que englobava três quartos de P4 e um quarto de P5. Em sua defesa, a Comissão Europeia argumentou que o período de análise de dano cobria o período considerado (2006) e que havia dados disponíveis acerca da produção de produto similar para o período considerado (2006). Além disso, arguiu que o Artigo 3.1 do Acordo Antidumping não requereria a análise de "major proportion" no período de análise de dumping, o que teria sido ratificado pelo Painel. 286. Assim, a Qualicaps instou que, ao se aplicar a mesma lógica ao presente caso, haveria a possibilidade de se utilizar das melhores informações disponíveis relacionadas ao critério de proporção significativa, sendo adequada a utilização das informações primárias de produção nacional mais recentes disponíveis, o que afastaria qualquer risco de distorção. Nesse sentido, ao se considerar os dados de produção do produto similar no Brasil em P4, a indústria doméstica representaria 61,7% da produção nacional. 287. Ademais, argumentou que, caso considerada a representatividade da indústria doméstica ao longo de todo o período de análise de dano, conforme alegadamente feito no contencioso China - Automobile (US), verificar-se-ia que, entre P1 e P4 (períodos para os quais há dados primários), a indústria doméstica representou entre 100 e 61,7% da produção nacional, mais do que registrado no mencionado contencioso. Naquele caso, o Painel considerou suficiente o registro de participação na produção nacional de, no máximo 54,2% e no mínimo 33,5% em todo período de dano. 288. A Qualicaps argumentou, nesse sentido, que, mesmo se considerado P5, com estimativa de participação mínima de 34,6%, o presente caso ainda apresentaria representatividade superior àquela considerada no Painel China - Automobile (US), visto que em três períodos a participação da peticionária ultrapassa 90% e em outro, 60%, enquanto, no caso China - Automobile, a indústria doméstica ultrapassou 50% de representatividade apenas em P1, conforme quadro a seguir.
